An employee that I have had concerns about ( and is currently working her notice period) has deleted all sent emails from her computer. This equates to 14 months business correspondence with existing and potential clients. I may be able to retrieve this data, I may not. What legal action could I take If i wanted against my employee, who has 2 months left to work.

Yes it would be interesting to hear the outcome of this. It's not clear to me there is anything you could do about it but of course a lawyer would be able to tell you what the state of play is there. | |

Unfortunately I think very little - it's not a DPA issue as the employee is deleting the emails - not using them for benefit outside of the organisation. Don't quote me though - I'm not legal expert.

I think so you must not allow him to delete all the sents emails, if he do so then you should deduct his pay.. | |
