What sort of contract do you have in place... is there anything written? Hopefully you have something written that you both signed that covers this eventuality!

This sounds potentially messy.

As Sasha says this is why it is important to have contracts in place even when working with friends... the nature of life is sadly that people fall out with others or people change their minds, get cold feet, circumstances change: you can never be too safe in business.
